Cresento Smart Shin Pads

1. Important Notice

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND CRESENTO LIMITED. BY DOWNLOADING, INSTALLING, OR USING THE CRESENTO APP ("APP"), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS"). IF YOU DO NOT AGREE, DO NOT USE THE APP.

These Terms govern your use of the Cresento mobile application and the accompanying hardware, the Cresento smart shin guards ("Device"). The App only functions with the Device, and use of the App is strictly limited to verified Device owners.

2. Company Information

This App is operated by Cresento Limited, a company incorporated in Hong Kong.

3. Services Provided

The Cresento App collects, analyzes, and visualizes football performance metrics derived exclusively from Cresento hardware. Metrics include, but are not limited to: fatigue index, steps, distance, acceleration, top speed, sprint speed, time played, movement states (walking, jogging, sprinting), idle time, calories burned, sprint/deceleration events, and visual data graphs.

Future versions may include AI-generated training plans and vision-based feedback, but these are not currently active features.

4. User Eligibility

There is no minimum age requirement to use the App. However, users under the age of 13 must do so under the supervision of a parent or guardian where required by applicable law.

5. License and Intellectual Property

All rights, title, and interest in the App, including software, algorithms, data models, designs, and content, are and shall remain the exclusive property of Cresento Limited. Use of the App is granted under a limited, non-exclusive, non-transferable, revocable license strictly for personal, non-commercial use in connection with the Device.

YOU MAY NOT:

Reverse engineer, decompile, or disassemble the App or its components
Modify, reproduce, sublicense, or distribute the App
Use the App to create derivative works or competitive products

Violations of these terms may result in immediate termination of access and legal action.

6. Data Collection and Privacy

The App collects motion-related data from Cresento smart shin guards, including:

Gyroscope (degrees/sec – X, Y, Z)
Accelerometer (G-forces – X, Y, Z)

User profiles are stored securely on Firebase, which complies with Apple's App Store privacy guidelines. No data is collected from the user's device itself, and no video or audio uploads are currently required or supported.

We do not knowingly collect personal data beyond user profile basics required to authenticate devices.

7. Third-Party Services

The App uses Firebase for authentication and data storage. Additional third-party services may be integrated in the future, and use of such services will be governed by their own terms.

8. Data Transfer

All user data is stored on Firebase servers. While no intentional cross-border data transfers currently occur, data may be stored in international servers depending on Firebase's hosting policies.

9. Product Warranty and Returns

Cresento hardware products may be returned within two (2) months of purchase for a full refund, subject to product inspection. Beyond this period, no returns or refunds will be accepted.

Digital services (e.g., software features or future AI upgrades) are non-refundable.

10. Limitation of Liability

You acknowledge and agree that:

The Device and App are used at your own risk
Cresento Limited is not liable for injuries, loss, or damages incurred during use
The Device does not prevent injury and should be used as a supplementary training tool

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRESENTO LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PERFORMANCE, PERSONAL INJURY, OR LOST PROFITS.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

12. Dispute Resolution

By using this App, you agree:

Not to participate in any class action lawsuit
That any disputes must be resolved individually through a competent court of jurisdiction

Arbitration is not required, but users waive any rights to class-wide or representative claims.

13. Modifications to Terms

Cresento Limited reserves the right to modify or update these Terms at any time. Continued use of the App after such modifications constitutes your acceptance of the revised Terms. Changes will be posted in the App and/or on our website.

15. Entire Agreement

These Terms, along with our Privacy Policy and any applicable hardware agreements, constitute the entire agreement between you and Cresento Limited concerning the Cresento App.
